XILFANX LLC Terms of Service

1. Agreement to Terms
By accessing, browsing, or subscribing to the services, applications, and websites provided by XILFANX LLC ("Company", "we", "us"), including EstateTrack™ and EduTrack™, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a corporation, trust, school, or other legal entity, you represent that you possess the authority to bind such entity.
2. Permitted Use & Account Integrity
Subscribers agree to use the Services solely for lawful operational, property management, academic, and administrative purposes. You are responsible for safeguarding account credentials, ensuring all user access grants align with organizational roles, and promptly reporting unauthorized access to support@xilfanx.com.
3. Intellectual Property Rights
All software, algorithms, UI components, codebases, APIs, logos, marks (including XILFANX, EstateTrack, and EduTrack), documentation, and design assets are the exclusive intellectual property of XILFANX LLC. Subscriptions grant a limited, non-exclusive, non-transferable right to access and use the platform during the active term.
4. Subscription Billing & Cancellations
Services are billed on a monthly, termly, or annual basis according to the tier selected. Subscription fees are charged in advance. Enterprise subscriptions may include dedicated service level agreements (SLAs) as set forth in specific corporate task orders.
5. Service Availability & SLA
We strive to maintain a 99.99% availability target across our production cloud systems. Scheduled maintenance windows are communicated in advance. We maintain automated multi-zone failovers to minimize operational disruption for property managers and academic institutions.
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions. Any legal action arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.
